Clarification Text Regarding the Processing of Personal Data

As Umut GÜRLER Mimarlık ve Tasarım Limited Şirketi (“Umut Gürler Interior Architecture” or “Company”); we attach great importance to the protection of the personal data of our prospective customers, customers, employees, employee candidates (interns and professionals), suppliers, and website visitors.

This Clarification Text has been prepared in the capacity of data controller to inform you in accordance with Article 10 of the Law on the Protection of Personal Data No. 6698 (“KVKK”) and the “Communiqué on Procedures and Principles for the Fulfillment of the Obligation to Inform”.

2. Purposes of Processing Personal Data

Your collected personal data (Identity, Contact, Customer Transaction, Transaction Security, Professional Experience, and Marketing Information) are processed for the following purposes in accordance with the general principles in Article 4 of the KVKK:

• Service Delivery: Execution of architectural and interior architectural project processes, preparation of exploration, quantity survey, and price offers.
• Human Resources Processes: Receiving internship and job applications, evaluating the suitability of candidates for the position (CV and Portfolio), organizing interviews, and creating a talent pool.
• Contract Processes: Establishment and performance of service contracts, execution, and confirmation of authorized signatories.
• Financial Operations: Issuing invoices, tracking current accounts, and ensuring financial reconciliations.
• Marketing and Communication: (Subject to your explicit consent) Celebrating special days of company officials, sending newsletters, introducing personalized projects, and announcing career opportunities.
• Legal Obligations: Providing information to authorized persons, institutions, and organizations (Tax office, Courts, etc.).
• Data Security: Execution of information security processes and keeping log records.

3. Method and Legal Reason for Personal Data Collection

Your personal data is collected in electronic or physical environments via our website (and our Talent HUB career portal), e-mail, phone calls, project meetings, business card sharing, and contracts.

These data are processed based on the following legal reasons specified in Article 5 of the KVKK:

• Stipulated in Laws: Issuing invoices as per the Tax Procedure Law and TCC.
• Performance of the Contract: Necessity for the project and service contracts and for the establishment of the employment/internship contract.
• Legal Obligation: Meeting the requests of authorized authorities.
• Legitimate Interest: Candidate evaluation processes and preservation of corporate memory.
• Explicit Consent: For marketing activities and cross-border data transfer processes.

4. Transfer of Personal Data (Domestic and International)

Your personal data may be transferred in line with the realization of the purposes listed above;

• Domestically: To our suppliers (subcontractors, furniture manufacturers), financial advisors, legal advisors, and legally authorized public institutions.
• Internationally: Since our website and Talent HUB server infrastructure are hosted in data centers located in Germany (Frankfurt) (OVHcloud SAS and Cloudflare infrastructure) due to technical necessities and data security, your data (including the files and information you upload) are considered transferred abroad. By using our services, you are deemed to have accepted this technical transfer.

5. Rights of the Data Owner (KVKK Article 11)

As a personal data owner, you can exercise the following rights by applying to our Company:

• To learn whether your personal data is processed,
• To request information if processed,
• To learn the purpose of processing and whether it is used appropriately,
• To know the third parties to whom data is transferred domestically or abroad,
• To request correction if processed incompletely or incorrectly,
• To request deletion or destruction within the framework of the conditions stipulated in the KVKK,
• To object to the occurrence of a result against you,
• To request compensation for damages in case you suffer damage due to unlawful processing.

6. Method of Application

To exercise your rights stated above, you can submit your requests in writing or via registered electronic mail (KEP) address, secure electronic signature, mobile signature, or by using your e-mail address previously notified to us and registered in our system.
